These Terms of Service ("Terms") govern your access to and use of BehAIv's website, certification programs, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Services. By creating an account or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1. Account Registration and Eligibility
Eligibility: You must be at least 18 years old and capable of forming a binding contract to use our Services.
Account Creation: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Professional Representation: You represent that any professional credentials, certifications, or employment information you provide is accurate and truthful.
2. Membership and Certification
Membership Terms: Memberships are annual subscriptions that automatically renew unless cancelled. You may cancel at any time, but fees are non-refundable except as required by law or within our 30-day money-back guarantee period.
Certification Requirements: To earn BehAIv certification, you must complete all required coursework, pass examinations with a score of 80% or higher, and maintain active membership in good standing.
Certification Validity: Certifications are valid for three years and require continuing education for renewal. We reserve the right to revoke certifications for violations of our Code of Conduct or misrepresentation of credentials.
Use of Certification: You may display your BehAIv certification badge and refer to your certification in professional contexts, but you may not misrepresent the scope or meaning of the certification.
3. Intellectual Property Rights
Our Content: All content, materials, features, and functionality of the Services, including but not limited to text, graphics, logos, course materials, and software, are owned by BehAIv or our licensors and are protected by copyright, trademark, and other intellectual property laws.
License Grant: We grant you a limited, non-exclusive, non-transferable license to access and use our Services for your personal, non-commercial use in accordance with these Terms.
Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services or content without our express written permission. You may not reverse engineer or attempt to extract source code from our software.
4. Prohibited Conduct
You agree not to:
- • Violate any applicable laws or regulations
- • Infringe on the rights of others
- • Share your account credentials with others
- • Use automated systems (bots, scrapers) to access the Services
- • Attempt to gain unauthorized access to our systems
- • Upload viruses, malware, or other malicious code
- • Harass, abuse, or harm other users
- • Misrepresent your credentials or certification status
- • Share or distribute course materials without permission
- • Use the Services for any commercial purpose without authorization
5. Payment and Refunds
Fees:You agree to pay all fees associated with your membership tier. Prices are subject to change with 30 days' notice to active members.
Payment Processing: Payments are processed through third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method.
Auto-Renewal: Memberships automatically renew at the end of each term unless you cancel before the renewal date. You will be charged at the then-current rate.
Refund Policy: We offer a 30-day money-back guarantee for new members. After 30 days, membership fees are non-refundable. Exam retake fees are non-refundable.
6. Disclaimers and Limitation of Liability
No Medical Advice: BehAIv provides education and certification, not medical advice. Our Services are not a substitute for professional medical judgment or clinical training.
No Employment Guarantee: Certification does not guarantee employment, promotion, or any specific career outcomes.
"As Is" Basis:Services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free.
Limitation of Liability: To the fullest extent permitted by law, BehAIv shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
7. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Services ceases immediately.
You may cancel your membership at any time through your account settings. Cancellation takes effect at the end of your current billing period.
8. Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration:Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in San Francisco, California, in accordance with the American Arbitration Association's rules.
Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.
9. General Provisions
Changes to Terms: We may modify these Terms at any time. Material changes will be communicated via email or through the Services. Continued use after changes constitutes acceptance.
Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and BehAIv.
Assignment: You may not assign or transfer these Terms without our consent. We may assign our rights without restriction.
